52 minutes0.75 CPD hours7 modulesDoctorsNurses & midwives

This course gives doctors and nurses in England a practical understanding of the Mental Health Act 1983 as it applies on the ward and in emergency settings, including the main detention sections, holding powers, section 17 leave, consent to treatment, patients' rights and the statutory forms. It focuses on the everyday errors that make detention unlawful or unsafe and how to avoid them, using worked examples and a case study.

What you will learn

  • Describe the purpose, criteria, duration and process for sections 2, 3 and 4, and the police powers under sections 135 and 136.
  • Use the holding powers under section 5(2) and section 5(4) correctly, including who can use them, where, and for how long.
  • Grant, record and review section 17 leave lawfully, including conditions and the duty to consider a community treatment order for longer leave.
  • Apply the consent to treatment rules in Part 4, including the three-month rule, Forms T2 and T3, and urgent treatment under section 62.
  • Explain patients' rights to information, to an Independent Mental Health Advocate and to apply to the Mental Health Tribunal, and the role of the nearest relative.
  • Recognise common paperwork errors, understand which can be rectified under section 15, and know what to do if a detention may be unlawful.
